You are accessing the GradeYourTenant® Services, a hosted application owned and furnished to You by MOR of RF, LLC. The GradeYourTenant® Services can be used to track Your experience with Your tenants, research other landlord's experience with their tenants, and facilitate communication among landlords.

You will receive a password and account designation upon completing this GradeYourTenant® registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under Your password or account. You agree to (a) immediately notify MOR of RF, LLC of any unauthorized use of Your password or account or any other breach of security, and (b) ensure that You exit from Your account at the end of each session. MOR of RF, LLC cannot and will not be liable for any loss or damage arising from Your failure to comply with these Terms and Conditions of Use.

When You use the GradeYourTenant® Services, You may only post and submit comments regarding a tenant or prospective tenant that are based on Your own, personal experience. You agree that You may not (and shall not) post comments or submit content that is heard from or obtained from others. YOU SHALL NOT POST ANY CREDIT REPOT INFORMATION OR OTHER INFORMATION OBTAINED FROM ANY CREDIT REPORTING AGENCY.

WHENEVER YOU VIEW, ACCESS, ENTER DATA INTO, OR OTHERWISE USE THE GRADEYOURTENANT® SERVICES, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF USE THAT ARE PUBLISHED HERE, INCLUDING ANY POSTED GUIDELINES OR RULES THAT MAY BE POSTED FROM TIME TO TIME. All such guidelines or rules are hereby incorporated by reference.

YOUR USE OF THE GRADEYOURTENANT® SERVICES CONSTITUTES YOUR AGREEMENT TO ALL SUCH TERMS AND CONDITIONS OF USE. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS OF USE, YOU MAY NOT VIEW, ACCESS, ENTER DATA INTO, OR OTHERWISE USE THE GRADEYOURTENANT® SERVICES.

The GradeYourTenant® Services may include the provision of links to other Web Sites ("Linked Sites"). The Linked Sites are not under the control of MOR of RF, LLC and MOR of RF, LLC is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. MOR of RF, LLC is not responsible for webcasting or any other form of transmission received from any Linked Site. MOR of RF, LLC is providing these links to You only as a convenience, and the inclusion of any link does not imply endorsement by MOR of RF, LLC of the site or any association with its operators.

As a condition of Your use of the GradeYourTenant® Services, You warrant to MOR of RF, LLC that You will not use the GradeYourTenant® Services for any purpose that is unlawful or prohibited by these Terms and Conditions of Use. You may not use the GradeYourTenant® Services in any manner which could damage, disable, overburden, or impair the GradeYourTenant® Services or interfere with any other party's use and enjoyment of the GradeYourTenant® Services. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided through the GradeYourTenant® Services.

You agree that You shall not:

• access, modify, copy, reproduce, publish, adapt, translate or create derivative works based on any part of the GradeYourTenant® Services.
• commercially exploit, market, license or distribute access to or use of the GradeYourTenant® Services.
• Manipulate identifiers, such as email headers, to disguise the origin of any content transmitted to or through GradeYourTenant computer systems.
• Relay email from a third party's mail servers without the permission of that third party.
• Use or cause to be used GradeYourTenant computer systems to facilitate the transmission of unsolicited or unauthorized material. This includes any promotional materials, URLs, "junk mail," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation that You may upload, post, email, transmit, or otherwise make available.
• Use "robots" or otherwise harvest other's email addresses from the GradeYourTenant® web site for purposes of sending unsolicited or unauthorized material.
• Upload, post, email, or transmit the same message, URL, or post multiple times.

You agree to use the GradeYourTenant Services only to post, send and receive messages and material that are proper and related to the GradeYourTenant Services. By way of example, and not as a limitation, You agree that when using a GradeYourTenant Service, You will not:

• Make personal communications unrelated to the interests of and business of GradeYourTenant.
• Post comments obtained from a third party, rather than Your direct tenant experiences.
• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
• Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
• Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless You own or control the rights thereto or have received all necessary consents.
• Download files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
• Advertise or offer to sell or buy any goods or services for any business purpose, unless MOR of RF, LLC specifically allows such messages and You pay the appropriate advertising fees to MOR of RF, LLC.
• Download any file or post any content that You know, or reasonably should know, cannot be legally distributed in such manner.
• Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material.
• Restrict or inhibit any other user from using and enjoying the GradeYourTenant Services.
• Violate any code of conduct or other guidelines which may be applicable.
• Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
• Violate any applicable laws or regulations.

Your participation in the GradeYourTenant® Services may be monitored, edited, censored or otherwise controlled by MOR of RF, LLC; however, MOR of RF, LLC has no obligation to monitor the GradeYourTenant® Services, web site or content.

MOR of RF, LLC reserves the right to review materials posted to a GradeYourTenant® Services and to remove any materials in its sole discretion. MOR of RF, LLC reserves the right to terminate Your access to the GradeYourTenant® Services at any time without notice for any reason whatsoever. MOR of RF, LLC reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in MOR of RF, LLC's sole discretion.

MOR of RF, LLC does not control or endorse the content, messages or information found in any GradeYourTenant® Services and specifically disclaims any liability with regard to the GradeYourTenant® Services and any actions resulting from Your participation in any GradeYourTenant® Services.

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such advertiser. You agree that MOR of RF, LLC shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the GradeYourTenant® website.

In consideration of Your use of the GradeYourTenant® Services, You represent that You are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to:

1. provide true, accurate, current and complete information about Yourself as prompted by the GradeYourTenant® Services' registration form (the "Registration Data") and
2. maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

You agree to indemnify and hold MOR of RF, LLC harmless from any and all claims, losses, damages, and costs (including attorneys' fees) arising from or relating to Your use of the GradeYourTenant Services. In addition, violations of these terms and Conditions of use may result in legal action against You and the termination, without notice, of Your GradeYourTenant ID and anything associated with it. GradeYourTenant and MOR of RF, LLC does not waive any rights by the failure to enforce this policy in every instance in which it might apply.

The GradeYourTenant® Services could include technical inaccuracies or typographical errors. MOR of RF, LLC may make improvements and/or changes the GradeYourTenant® Services at any time.

MOR of RF, LLC may change these Terms and Conditions of Use at any time. Changes will be effective when posted here. You are responsible for regularly reviewing the Terms and Conditions of Use posted here.
